1. Acceptance of Terms
By accessing or using any part of the Automate CRM website, web application, mobile application, or any related services, collectively referred to as the “Services”, you agree to be bound by these Terms of Use.
If you do not agree with these Terms, you must not access or use the Services.
These Terms form a binding agreement between Think Tank T2 (Pty) Ltd, referred to as “Think Tank”, “we”, “us”, or “our”, and you, whether you act in your personal capacity or on behalf of a business or organisation.
2. Eligibility and Capacity
By using the Services, you confirm that you:
- are at least 18 years old or the age of majority in your jurisdiction;
- have the legal capacity to enter into binding contracts; or
- if acting on behalf of a company or organisation, are duly authorised to bind that entity.
If you use the Services on behalf of a company or organisation, “you” and “your” include that company or organisation.
4. Account Registration and Security
To access certain features, you may be required to create an account using an email address and password, or another approved login method.
You agree to:
- provide accurate, complete, and up-to-date information;
- keep your login details confidential and secure;
- notify us promptly if you suspect unauthorised access or a security breach related to your account.
You are responsible for all activities that occur under your account. We may suspend or terminate your account if we reasonably believe it has been compromised, used unlawfully, or used in breach of these Terms.

We may refine, update, add, remove, or change features of the Services from time to time. We do not guarantee that any specific feature will always be available.
6. Subscriptions, Fees and Billing
Some parts of the Services may be provided on a paid subscription basis.
Subscription pricing, including promotional offers, free trials, renewal rates, billing cycles, and package limits, will be displayed on our website, within Automate CRM, or communicated to you from time to time.
By starting a subscription, you authorise us or our payment processors to charge the applicable fees to the payment method you provide. Subscriptions may renew automatically at the end of each billing period, unless cancelled in accordance with the cancellation instructions provided.
- Fees are generally quoted in South African Rand (ZAR), unless stated otherwise.
- Fees may be exclusive of applicable taxes, which may be added where required.
- Unless otherwise stated or required by law, fees are non-refundable.
We may change subscription pricing from time to time. Where reasonably possible, we will give notice, and changes will apply from the next billing cycle.
7. Acceptable Use and Prohibited Conduct
You agree to use the Services only for lawful purposes and in a responsible manner. You must not:
- use the Services to violate any law, regulation, or code of conduct;
- infringe or violate the rights of others, including intellectual property, privacy, and personality rights;
- publish or transmit unlawful, harmful, defamatory, abusive, hateful, discriminatory, violent, sexually explicit, or otherwise objectionable content;
- engage in fraudulent, misleading, or deceptive practices, including false information or misrepresentation;
- interfere with or disrupt the integrity, security, or performance of the Services;
- attempt to gain unauthorised access to any account, computer system, or network;
- introduce viruses, malware, harmful code, bots, scrapers, or automated systems except where expressly permitted;
- reverse engineer, decompile, or attempt to derive the source code of the Services, except as permitted by law.
8. Your Content
You may upload, post, publish, submit, or share content through the Services, including text, images, logos, media, documents, business information, customer information, lead records, notes, and other materials. This is referred to as “User Content”.
You remain the owner of your User Content. However, by submitting User Content, you grant Think Tank T2 (Pty) Ltd a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, reproduce, host, store, modify, adapt, publish, display, and distribute such User Content only to the extent reasonably necessary to provide, operate, improve, market, and protect the Services.
You represent and warrant that:
- you have all necessary rights, licences, and consents to submit the User Content;
- your User Content does not infringe any third-party rights;
- your User Content does not violate any applicable law.
We may remove or restrict access to User Content that we reasonably believe breaches these Terms or any applicable law.
9. Intellectual Property
All rights, title, and interest in and to the Services, including software, source code, design, trademarks, logos, databases, workflows, platform structure, and content created by us, are owned by or licensed to Think Tank T2 (Pty) Ltd and are protected by applicable intellectual property laws.
Except for the limited rights expressly granted to you in these Terms, no rights are granted to you in or to the Services or any related intellectual property.
10. Privacy and POPIA
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 and other applicable laws.
Our Privacy & Cookies Policy explains how and why we collect, use, store, protect, and share personal information, as well as your rights as a data subject.
By using the Services, you acknowledge that you have read and understood our Privacy & Cookies Policy and agree that we may process personal information as described in that policy.
11. Third-Party Services and Links
The Services may contain links to third-party websites, integrations, payment processors, communication tools, analytics tools, hosting providers, telecom providers, and other services that are not operated or controlled by us.
We are not responsible for the content, terms, privacy practices, security, or availability of third-party services. Your use of third-party services is at your own risk and is subject to their respective terms and policies.
12. Disclaimers and No Warranties
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no representations or warranties of any kind, whether express or implied.
We do not warrant that:
- the Services will be uninterrupted, error-free, secure, or free from viruses;
- the Services will meet all your specific requirements;
- any specific feature will always remain available;
- the Services will be fit for a particular purpose beyond what is expressly agreed.
You use the Services at your own discretion and risk.
13. Limitation of Liability
To the maximum extent permitted by law, Think Tank T2 (Pty) Ltd, its directors, employees, agents, contractors, and affiliates shall not be liable for any indirect, consequential, special, or punitive damages, including loss of profits, revenue, business, goodwill, data, or use.
Where liability cannot be excluded but may be limited, our total aggregate liability to you for all claims arising out of or in connection with the Services or these Terms shall not exceed the total amount of fees you have paid to us for the Services in the 3 months immediately preceding the event giving rise to the claim.
14. Indemnity by You
You agree to indemnify, defend, and hold harmless Think Tank T2 (Pty) Ltd, its directors, employees, contractors, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your use of the Services;
- your breach of these Terms or any applicable law;
- your User Content;
- any third-party claim relating to your use of the Services or your User Content.
15. Suspension and Termination
We may suspend or terminate your access to the Services, in whole or in part, where:
- you materially breach these Terms or any applicable law;
- we are required to do so by law, court order, or regulatory authority;
- your use of the Services creates a security risk;
- your use disrupts other users or exposes us to potential liability;
- your subscription is cancelled, expired, unpaid, or otherwise not in good standing.
You may stop using the Services at any time and may cancel your subscription using the cancellation mechanism provided in your account or as otherwise directed on our website or application.
16. Changes to These Terms
We may update or modify these Terms from time to time to reflect changes in our Services, business practices, legal obligations, or applicable law.
When we make material changes, we will take reasonable steps to notify you, for example by updating the “Last updated” date, providing a notice within the Services, or sending an email where appropriate.
Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
17. Governing Law and Jurisdiction
These Terms and any dispute arising out of or in connection with them or the Services are governed by the laws of the Republic of South Africa, without giving effect to any conflict of law principles.
You agree that the courts of the Republic of South Africa will have jurisdiction over any disputes arising from or related to these Terms or your use of the Services.
